9. Availability of Products

Sparkes only processes an order placed by a Customer after confirmation of the respective payment, so Sparkes cannot guarantee the availability of the items until the aforementioned processing begins. The estimated shipping date is 24 hours. In addition to the estimated shipping time, the transport time depends on the chosen carrier, as well as the destination of the order.

Sparkes only ships on weekdays. In this way, neither weekends nor holidays are counted for order delivery estimates. In any case, estimated delivery dates are merely indicative.

If any product ordered is unavailable, and after contacting the supplier inquiring about the possibility of replacing the missing item, Sparkes will contact the customer if the delivery time or the price of the item changes, and the order will only proceed after consent given by the customer.

In case of absolute unavailability of stock of the product ordered, and if it is not possible to offer the Customer any product of equivalent quality and price or if the Customer has not given his consent to change the order initially placed, Sparkes will reimburse the amounts spent by the Customer, within a maximum period of 14 (fourteen) days after the notice of cancellation.

Any delay verified in the shipment of items, in view of the estimated dates presented, does not entitle the Customer to any compensation.

10. Shipping costs 

The prices indicated on the products already include shipping costs for mainland Portugal.

11. Cancellations, Exchanges and Returns

The following conditions and terms are only applicable to purchases made at https://sparkes.pt. The customer may cancel his order at any time until it is shipped, with the right to a refund of all amounts paid. Upon receipt of the order by the Customer, he may exercise his right of free termination under the legally established terms and indicated below, namely, in Decree-Law no. 24/2014, of February 14th.

Failure to pay for the order within 4 days following the date on which it was definitely placed implies its automatic cancellation.

Pursuant to the provisions of Decree-Law no. 7/2004 of January 7th (with the amendments conferred by Decree-Law nº.62/2009, of March 10th and by Law nº.46/2012, of August 29th), regarding electronic commerce, Sparkes reserves the right to unilaterally cancel the order whenever there is a programming error, a malfunction of Sparkes' computers, as well as the contractual proposal arriving deformed at its destination and the error affects an essential element of the contract.

The customer has the right to terminate the contract without incurring any costs within a period of 30 (thirty) days from the day following the day: (i) on which the customer or a third party indicated by him, other than the carrier, acquires possession of the good or in the case; (ii) in which the customer or a third party indicated by him other than the carrier, acquires physical possession of the last good when the consumer has ordered several goods in a single order and the goods are delivered separately.

In order to exercise his right of free termination, the Customer must communicate, to the contacts indicated above in Condition 7, his decision to terminate this contract by means of an unequivocal statement (for example, letter sent by post, fax or email).

In order for the free termination period to be respected, it is sufficient that your communication regarding the exercise of the right of free termination is sent to Sparkes before the termination period.

In the event of termination of this contract, all payments made will be refunded to the Customer, including delivery costs (with the exception of additional costs resulting from the possible choice of a shipping method other than the less expensive normal shipping method offered by Sparkes), without undue delay and, in any case, no later than fourteen (14) days from the date on which Sparkes is informed of the Customer's decision to terminate this contract.

In order to speed up the refund process, the refund will be made by Bank Transfer, so the NIB/IBAN must be provided to Sparkes. Sparkes informs you that you can withhold the refund until you have received the returned goods. The customer must return the goods, without undue delay and no later than 14 (fourteen) days from the day on which he informed Sparkes of the free termination of the contract, considering that the same is respected if the Customer returns the goods before the expiry of this period of 14 (fourteen) days. The customer must fully bear the costs of returning the goods in the event of exercising the right of free termination of the contract. In the case of returning goods that, due to their nature, cannot normally be returned by post, the customer must bear the direct costs of said return. If you wish to exchange items, the customer can go to or contact Sparkes, which will provide you with all the information about the exchange process. The customer must not, under any circumstances, send the articles to Sparkes without having made prior contact, as they will not be received. When returning and exchanging items, the Customer must respect the following conditions: return of items in good condition, with complete original packaging and accompanied by the respective receipt or original invoice; Sparkes does not accept the return or exchange of items after they have been used. After contacting Sparkes and being given the return instructions, can send us the item duly packed, with packaging original to the following address: Sparkes & Sparkes, Lda – Rua 25 de Abril, 120 , 4825-010 Agrela. All items will be checked upon arrival at our service and only those that respect the return conditions will be accepted for exchange or return. the refund will only be made after checking the status of the product. Sparkes reserves the right to not accept articles that do not comply with these conditions.

12. Applicable Law

All purchases made on the https://sparkes.pt website are subject to Portuguese legislation. Any conflict or divergence of interpretation of the General Conditions of Contract and Use will be submitted to the competent Portuguese Court. If the customer is located outside mainland Portugal, Sparkes informs you that any legal proceedings must be forwarded to the Portuguese Courts.
